Terms and Conditions
TERMS: M&J Organics, LLC (M&J Organics) terms are net 30 from the date of invoice to customers with established credit. Non-Credit customers are required to pay for their product at the time of pickup or delivery by cash, check, cashier’s check or money order. No post-dated checks will be accepted. At our discretion, any sale may be deemed COD at any time. All accounts over 30 days from invoice date are considered due and will be charged a finance charge of 2% per month (APR 24%). All accounts over 60 days will be converted to a cash only basis. All accounts over 90 days will be turned over for collection with costs of collection and the finance charges added to your balance. All credit customers agree to comply with these terms and agree that this contract shall be governed by Virginia State Law. Any legal action pertaining to the sale of goods from M&J Organics shall be venued in whichever county is deemed most appropriate by M&J Organics. Please do not hesitate to contact our accounting department if you have questions about your account.
PRICES: Prices are in US Dollars, are based on present market conditions, and are subject to change without notice.
DELIVERY: We will make every effort to deliver on the agreed date, but if for any reason we are unable to deliver, customer agrees that M&J Organics shall not be liable to customer for any claims resulting from M&J Organics inability to deliver. The same shall apply to inadequate delivery site provided by customer. Product will be delivered (dumped) on your driveway. Delivery truck wheels cannot leave the pavement/asphalt/concrete, etc. for any reason.
RESCHEDULING: If you need to reschedule your delivery, we must be advised of your wish to do so by 3:00 p.m. the day before scheduled delivery. Failure to do so may result in a $100 re-mobilization fee.
CANCELLATIONS: Regular Mix deliveries – We must be advised of your cancellation by 3:00 p.m. the day before scheduled delivery. Failure to do so may result in a $100 cancellation fee. BioMix/Special Mixes - Cancellations will not be accepted on any custom mixed product orders that differ in any way from our “regular mix,” in ratio & mix components. Orders may be cancelled by M&J Organics due to late payments.
TESTING: We test our Soil Blends and BioMixes several times per year by submission of soil samples to A&L Eastern Laboratories in Richmond, VA. Test results are only made available to customers once a signed Purchase Agreement is received.
RETURNS & CLAIMS: All sales are Final – No Returns.
